Trust Litigation Attorney

We are seeking an experienced Trust Litigation Attorney with 5–10 years of experience handling contested trust and estate matters. The ideal candidate will have a strong background in probate court litigation, including trust disputes, fiduciary litigation, and estate-related conflicts, and be comfortable managing cases from initial petition through resolution or trial.

Trust Litigation Attorney Responsibilities

  • Independently manage trust and estate litigation matters from initial filing through resolution.
  • Handle contested trust proceedings, including trust contests, breach of fiduciary duty claims, undue influence allegations, and disputes over capacity.
  • Draft and respond to petitions, objections, motions, and legal memoranda with strong analytical and persuasive writing skills.
  • Conduct and defend depositions of trustees, beneficiaries, experts, and other witnesses.
  • Prepare accountings, discovery requests and responses, and related pleadings.
  • Provide case analysis, risk assessment, and strategic recommendations to trustees, beneficiaries, and fiduciaries.
  • Represent clients in probate court hearings, mediations, settlement conferences, and alternative dispute resolution proceedings.
  • Prepare matters for trial, including witness preparation, exhibit organization, and case strategy development.
  • Maintain consistent and professional communication with clients, opposing counsel, court personnel, and internal team members to ensure effective case progression.

Trust Litigation Attorney Requirements

  • 5–10 years of experience in trust and estate litigation or probate litigation.
  • Strong knowledge of trust administration, fiduciary duties, and the California Probate Code.
  • Experience handling trust contests, accounting disputes, and fiduciary breach claims.
  • Excellent written and verbal communication skills.
  • Ability to independently manage a caseload and prioritize competing deadlines.
  • Licensed and in good standing with the California State Bar.
