What Is Race and Color Discrimination?
The laws enforced by EEOC prohibit an employer from treating you differently, or less favorably, because you or a friend, parent, or someone else you associate with is of a particular race or color. Employers also may not treat you differently, or less favorably, because you have personal traits, such as hair texture, color or certain facial features, associated with a particular race.
The law forbids discrimination when it comes to any aspect of employment, including hiring, firing, pay, job assignments, promotions, layoff, training, fringe benefits, and any other term or condition of employment.
What Could Discrimination Look Like?
Race or Color discrimination can be presented as racial jokes or slurs in the workplace, derogatory remarks about a person’s race or color, or displaying racially offensive symbols.
In the hiring process specifically, discrimination can look like only interviewing candidates whose names are traditionally associated with specific cultures, passing on a candidate because of the color of their skin, or not allowing certain facial features that are commonly associated with a specific race.
A big example of this would be a policy of no beards. If the no beard policy has no relation to job performance it could disproportionately eliminate employment opportunity based on a group’s race, or national origin.
